The NRA issued an alert today announcing that thirty-four  state attorneys general have urged the US Supreme Court to hear NRA v. Chicago.  They want the highest court in the land to rule that the Second Amendment is incorporated against state and local governments, as well as the federal government.

They are basing their recommendations on the Due Process Clause of the Fourteenth Amendment, which has been used to extend civil rights protections to minorities.  A three-judge panel of the Seventh Circuit Court of Appeals ruled this year that the Second Amendment does not apply to state or local governments.  (See my post, “7th Circuit contradicts Nordyke, rules that 2nd Amendment doesn’t bind states,” 06-05-09, tagged NRA v. In the same way that it took time for civil rights legislation to come to bear against state and local discrimination against minorities, the battle to secure the rights of gun owners will not be won overnight.  But, as the folks on the other side of the debate are fond of saying, “This is a good step in the right direction.”

    Def Mech,

    I came across your blog and really appreciate the efforts you are making to get the word – and the “correct” word at that. I would like to see if we can list each other’s blogs on our blogs, so as to begin a way of ‘connecting’ for all of our conservatives who are trying to uphold the Constitution and Bill of Rights. I am a student of the Constitution as of the past two years, which I have spent learning about politics, the Constitution, Bill of RIghts, Founding Fathers, and more. I am a homeschooling mother of three (one is graduated and attending college) and i teach a class on the book The 5,000 Year Leap and The Making of America to the teens and parents in our Homeschool Support Group.

    My blog is more about the Constitution and helping educate people when our Constitutional rights are usurped. I believe strongly that the 2nd amendment is one of our last bastions in this nation. May God protect us and guide us in our efforts.
