House Bill 45, the anti-gun rights campaign begins in earnest

The first formal volley in what is projected to be an Obama Administration onslaught on the Second Amendment was fired when H.R. 45 was introduced into the new congress on January 6th by Representative Rush (D) Chicago, Illinois. H.R. 45 is a bill that licenses owners of handguns and semi-automatic weapons with magazine wells. The bill also registers handguns and semi-autos upon transfers, which must be conducted through a licensed dealer, with a few exceptions for family members and temporary loans to presumably licensed individuals. (Interestingly enough, you seemingly could transfer a gun to an 18-year old offspring without a registered event, but you apparently could not transfer the same weapon to a spouse without going through a licensed dealer. Who would of thunk it?)
In an Orwellian twist, a person under 18 may only effectively possess a firearm in an act of self-defense, after magically gaining access to the gun in violation of the law, having had no previous legally sanctioned training in the use of firearms. (This looks a lot like the D.C. gun ban which requires either precognition of a break-in or criminal agreement to a “time out” that allows the gun owner to assemble/unlock a weapon for defensive use.)
One of the problems with registration is that it is often a precursor to confiscation. It has happened in Britain, Australia, New York, Louisiana, and California, to name a few places where the rich and powerful decided to disarm “The Great Unwashed.” As Dianne Feinstein wistfully remarked over her real desires regarding the Clinton “Assault Weapons” Ban, “If I could have gotten 51 votes in the Senate of the United States for an outright ban, picking up every one of them, Mr. and Mrs. America, turn them all in, I would have done it.”
Or, as “Conservative” Charles Krauthammer said in a Washington Post article about the Clinton Ban quoted on the site listed immediately above, “…Its only real justification is not to reduce crime but to desensitize the public to the regulation of weapons in preparation for their ultimate confiscation.”
Probably the most ironic thing about registration schemes is that criminals can evidently not be forced to register or turn in their weapons under such a law. In Haynes, the courts established that convicted felons, or other “prohibited persons,” who may not own a gun, can not be forced to incriminate themselves through registration. These ploys only restrict the rights of, and provide inconvenience for, law-abiding citizens.
H.R. 45 requires the licensing of anyone who owns a handgun or semi-auto with a magazine well. To obtain a five-year license, a citizen must submit a passport photo, and an application with a thumbprint. Persons desiring a license must pass a test designed by the Attorney General. (Think Reno Lieutenant Holder! Ouch!) The initial application requires a fee now capped at $25. Of course, the requirements can always be tightened and the fees can be raised.
We might expect any misdemeanor conviction or even traffic offense to become a ban to ownership. We might also expect psychiatric exams to be required to own an affected weapon. In some places, gun ownership requires certification by prominent citizens as to the character of the applicant. Understand! The rich and powerful will always have recourse to armed force through preferential laws and bodyguards.
This draconian proposal bans possession of any firearm by a person under 18. The discrimination against youth all but guarantees the death of the shooting sports and the ownership of guns for self-defense from crime, tyranny and genocide.
The bill imposes increased restrictions and reporting requirements on already heavily-regulated licensed dealers. It establishes a national registry of affected weapons.
H.R. 45 also makes it a federal crime to fail to report the theft of a firearm within 72 hours. Understand! The gun must be locked up to keep it away from anyone under 18. The police would undoubtedly do detailed investigations of any thefts to see if they could bust the owner for improper storage.
Under this bill, the Attorney General will conduct studies to present to Congress regarding the use of handguns and semi-autos in crime. We have here the typical Liberal positive feedback loop that goes something like this. The restrictions don’t reduce crime, therefore, we need more restrictions. Those restrictions don’t reduce crime, therefore, we need more restrictions. Those restrictions don’t reduce crime, therefore… Positive feedback loops are like addictive behavior, shrieking feedback in sound amplification systems, or computer viruses that overload hard drives. They are ultimately destructive of the very systems that they were originally intended to benefit.
Understand! Major research surveys of multiple studies (almost 400) done by the Centers for Disease Control, the National Academy of the Sciences and the Swiss-based Small Arms Survey indicate that there is no significant evidence that gun control reduces crime, or that gun ownership causes crime and violence. All in all, H.R. 45 gives the anti-gun organizations that supported Obama and the Democrats much of the substance of their wish lists for the new administration. H.R. 45 infringes and lays the groundwork for much further infringement of the rights of American Citizens to armed self-defense against crime, tyranny, and genocide recognized by the Second Amendment and numerous state constitutions. Contact your legislators to oppose this bill! Tell your friends who value liberty that H.R. 45 jeopardizes their hard-won birthright of freedom!

How appropriate that the number of the bill (45) should be the solution TO the bill. (.45)
This bill is so draconian that even with a
libral Congress it seems to me to be unlikely to even come to the floor for a vote. Of course, with the Chairman of the Judicary Committee being totally anti-gun, maybe that could happen.
What I think will happen is that bills like this will be introduced as the crazy high end of the gun control effort. Later, the bills will be introduced that they really intend to push through. Those later bills will seem so mild and reasonable by comparison, that they will not generate the kind of public uproar that could stop them. It’s like the technique a magician uses to distract the audiance from seeing what he is really doing.
This is not to say that we should not generate a huge response to H.R.45. We should respond with such an unbeleavably huge letter, email, and telephone response that House Members tremble to co-sponser the gun control bills to follow.
They will have to pry the arms out of my fingers. We hire these people to protect the rights set forth by our fore fathers. Lets think about firing a few of these boys.
It would be a ABOMINATON to abrogate the Founders’ clear intention with regard to the 2d Amendment to enact the proposed Bill 45. There are 90 million gun owners in the United States who will NOT stand for the enactment of this proposed Bill and will take action accordingly if such a Bill is enacted. Furthermore, the U.S. Supreme Court has already upheld the right of the citizens of the Country to bear arms. In the dangerous society we live in the ONLY way for a law abiding citizen to protect himself is to self-defend his home and family with firearms. The enactment of this proposed Bill will place our 2d Amendment rights on a slippery slope and CANNOT BE CONDONED!

The majority of the people in the United States voted for the democratic candidate. The democratic party is anti-gun. I would advise as many people as possible to contact your congressman and senators to protest this bill. Keep track of your representatives record on this issue. If you don’t like their views vote for a different candidate who shares your views. Do most people know the difference between a democracy and a republic? The U.S. is not a democracy. In a democracy the people choose whether or not a bill becomes law. The U.S. doesn’t work like that. The people of the United States need to find every way possible to defeat this bill. The government is turning toward a socialist agenda. Gun confiscation is part of the agenda.

as a first time gun owner who just recently bought a gun legaly I would hate to know that I would be loosing a right that has been in palce for a couple of hundred years. I will be more than happy to keep track of all of the votings on gun regulation to make sure that if my representatives do not vote for our rights and to protect our rights then I will definatley vote them out the next go round. Guns don’t kill people, people kill people. Do not let them take away our rights to protect ourselves. Also, one of the only things that are keeping other super powers from invading our country and trying to take us over is the fact that we as free americans can and do own guns and if any one were to ever try to invade they would not only have to deal with our military but also the citizens that have there guns at home and can help defend against any kind of invasion. No country in the world wants to invade a country that not only has a strong military, which could be beat by a large enough invasion force but then they would have to deal with all of the non-soldier combatants that would arm themselves to defend this great country. There is not a army in the world that could stand up to that.
I would suggest that if a law is passed requiring everyone to register their guns with the federal government…don’t register them. Criminals won’t admit to owning weapons. That’s why they are crimals because they break the laws. The politicians seem to be under the impression that if they pass another law leaning towards banning gun ownership that all of a sudden criminals will then become law abiding citizens. It would be rude to call them stupid so I’ll be rude. They’re stupid morons. The politicians are protected on Capital Hill with enough fire power to invade a small country. The president travels with a sniper team with classified weapons. I’m waiting for the politicians to give all of this up to show support for house bill 45. That’ll never happen.
You can see where this is all leading. It used to be the federal government was supposed to protect the citizens from foreign invaders by protecting our borders. Now congress is trying to protect themselves from those within the border (armed citizens). This economic depression we are in is going to create turmoil in this country when people get desperate. Our gutless congress-people don’t know what to do about it and they are scared.

The supreme power in America cannot enforce unjust laws by the sword because the whole body of the people are armed, and constitute a force superior to any band of regular troops that can be, on any pretense, raised in the United States”.
Well it did not take long for the MESSIAH to go back on his campaign promises such as NO lobbyists in his administration and OH did I mention he said he would not go after gun owners with gun control measures…WOW what a liar but I guess any one with a brain knew that…I wonder when he will turn his militia loose on the AMERICAN PEOPLE?? If every gun owner would join the National Rifle Association, or other large gun owners association, we would show a solidarity that would be hard to ignore. More dues-more lobbying in Congress. We need to keep up our membership and stand behind our Association. Have a monitor in there day and night–Keep Up The Pressure!

I completely agree with Kevin. If this idiotic law passes, don’t submit to the registration. If all of us stand together on this they will back off just like any other bully. You really have to marvel at these idiots using the name of a child (Blair Holt),who was killed by a CRIMINAL, to evoke an emotional response from people to support this bill. If this is the direction we are going maybe what we need is another revolution so we can get rid of the politicians who won’t do the will of the people. Don’t be complacent!!! Richard Shelby has revisited an earlier controversy by suggesting that Barack Obama is foreign-born and not eligible to be president. Shelby is correct in stating that Obama has not released his birth certificate. Instead, Obama’s campaign released his certification of live birth — not his actual birth certificate. The certification acknowledges birth but does not include such details as place of birth. State officials in Hawaii sought to stem the controversy during the campaign, claiming that they had checked health department records and determined that Obama was in fact born in Hawaii. Also, Factcheck.org reproduced an announcement of Obama’s birth that was published in the Honolulu Advertiser on Aug. 13, 1961, nine days after his birth. It included his parents’ address in Honolulu. Arch-conservative Alan Keyes is among those who allege that Obama has failed constitutional muster to become president. The founding fathers considered any attemp at gun control to be “High Treason”. (Read the new book, The Founding Fathers Second Ammendment”).
I believe we should use the recent SCOTUS Heller decision as a basis for charging our representatives who introduce any form of gun control legislation with treason.

HR 45 is one of the worse pieces of proposed law I’ve ever seen. Until you pay police officers like sports stars, this bill will result in a massive increase in crime to which this country has never seen. Are you also planning to build 50,000 new prisons to hold all of us? Might as well drop it. You would do better trying to eleminate the 2nd Ammendment.

As days go by, I become more and more ashamed of this country and the politicians that are trying to control every move and thought.. what happen to our rights to vote on laws or bills? my father survived WWII, 3 tours, D-Day, Utah Beach,the Rhineland, Ardenes and other parts of Europe.. He would be turing over in his grave with the crap that is going on in this country today.. I use to watch that man cry when he, rarely, talked about how the war was and the friends he saw die in front of his eyes so that people in this country could live free and be protected from harms ways.. what the hell is going on? I for one, have guns to protect my family and things that I have worked my hind end off for. I will not hand over my rights to anyone without a fight. they can put me in jail or fine me what ever they want. they cant get blood when theres none there. I am a single mother raising two boys to be respectful, honest and caring young men. I have worked very hard at this inspite of all the other crap that is going on this world to ensure that my children get the chances to live free and enjoy what this country has to offer and to be grateful in what they have. if things keep on the way they are, my boys will have nothing to look forward to when they are adult citizens. I wonder if they will have rights. Will they be able to live with the honor of what our forefathers brought to this land or even what thier grandfather fought so hard for. How is it right for some politician, that thinks he knows whats best for this country, go and take all that away. In the long run, my ancestors, my father, his commrades, the fallen soliders and all the soldiers that are currently defending our country and our rights, will have done it for nothing! what a way to honor those and thier memories! They sacraficed everything for thier country!!! I am truely ashamed!!! I have written my congressmen, senators, governors, and the President on issues from the recession to this gun control bill. In other words take the Decoration of Independence and throw that and that other thing what’s it called? Oh yea the Bill of Rights and throw them out the window. Once presidence has been set and this is allowed to go through you will open the doors for every dept head in government (i.e. Sec. of Defense, Sec. of the Interior Sec. of Finance, list goes on and on ) to change laws at will with out the lawmaking body of this governments involvement or oversight. Everybody is talking about such severe measures that the government will take. I doubt that they will use nerve gas or biological weapons against US citizens. But if they do, it’s possible, are you prepared? Think about it logically. If you have fought in a war you would think about all of the possibilities and come up with a plan to prepare for it. Have other weapons other than what you have at home. Don’t whine about it, prepare for it. Big difference. Let’s prepare. You have to have some support. Don’t email about it, actually do something about it. Everybody who has emailed this site has already been identified. It’s not going to happen for at least a few years. I remember in school studying what Hitler did in the late thirties and how he said all those so called nice words that he wasn’t a bad person but look what he did! We now have a so called president that is trying to do the same this Hitler did and people are buying it. There are NO cosigners to this bill and will never become law. President Obama supports gun ownership but not weapons equipped with magazines that hold multiple, uninterrupted clips. This email has been sent by those attempting to convince law-abiding gun owners that their right to own weapons and ammo will be curtailed by the President and Congress. It is the extreme right trying to get their way through FEAR. Wake up Americans….get the truth before you swallow these lies. This Blair Holt Bill is going nowhere!

I DID vote for President Obama and continue to support him as he corrects the errors and restores our rights that were suspended during GWB’s reign. The right is using guns, gays and abortion to strengthen their ever-shrinking membership rolls and if we law abiding gun owners fall for the same fear tactics thast got us into Iraq, we will be stripped of our rights as American citizens because we let our passions get in the way of plain smarts and doing the reading to determine the truth. We must STOP listening to the likes of Rush L, Michael S, Bill O’R and Shawn H and READ if we want the truth! Jobs in America will keep us strong….not hugging our weapons blindly.

I find it hard to believe that you served in Vietnam or know anything about guns. Semi-automatic firearms may have magazines that hold cartridges or rounds. They do not ever have “magazines that hold multiple uninterrupted clips.” If you knew as much about guns as you do about Democrat talking points, you would be more credible.
You say that you believe that law-abiding gun owners have nothing to fear from Obama. Let’s look at his performance to date.

The Obama Administration has effectively banned concealed carry in national parks by refusing to appeal the liberal judge’s injunction against the Bush rule.
Attorney General Holder called for a “renewal” of the Clinton semi-auto ban. If they use last year’s HR 1022 as a model, it will cause serious problems for law-abiding gun owners.
Speaker Pelosi called for gun registration. The only registration bill currently in Congress is HR 45. The Obama Administration has continued to parrot the misstatement that 90% of crime guns seized in Mexico came from the US. (The real number is 17%.)
Obama has endorsed the OAS Inter-American Convention against the Illicit Manufacturing of and Trafficking in Firearms, Ammunition, Explosives, and Other Related Materials. This treaty could be used as a vehicle to force government licensing of ammunition reloading and the establishment of federal roadblocks across the country to check for possible contraband that might be on its way to Mexico. (Before you discount the possibility, remember that there was a relatively recent push by anti-gunners to have OSHA declare ammunition to be an “explosive.” That designation would have required store owners who sell ammo to evacuate their buildings in the event of a thunderstorm!)
Under Obama, two US Army post commanders have issued orders requiring soldiers under their authority to register all firearms, even if those guns are always kept off post. Where is that registration requirement permitted in the Constitution?
Given Obama’s dismal personal record on guns and his performance over the first 100 days, I would say that gun owners have a lot to worry about. Obama’s history of support for anti-gun rights laws and opposition to virtually every pro-Second Amendment proposal speak much more loudly than his hollow campaign pronouncements.

I believe that Don and you are either blinded by Obama’s rhetoric, or that you are part of the Democrat Machine’s “Truth Police” who seek to silence all opposition to the socialist policies of “The Chosen One.”
In either case, please learn something about guns, before you try to preach to actual gun owners who are concerned about their individual rights to armed self-defense against crime, tyranny, and genocide!

If we don’t start pouring notes into Washington over our concerns along with the online form: “A Vote of No Confidence”, this may truly come to pass. If the Silent Majority doesn’t start screaming “Foul”, then we’ll have only ourselves to thank for any legislation getting passed. This is only the beginning. Of course, you know that when people start getting jailed over these protests that the detention camps have already been built.
This is just the beginning. Just watch our rights erode before our very eyes. Write or call Washington with your thoughts. If they don’t hear from us, they’ll never know!
God save us all for the future looks very bleak under this president. Oops, I forgot… as Obama says… We are no longer a Christian nation. It seems that he forgot to say that we are no longer a democracy, too. Socialism is here and we’ll never come close to center for years.

This bill must be killed.
First of all, this is a ploy to confiscate all our firearms in the future, which would violate the 2nd Amendment, but Obama and his cronies don’t care about the that or anything that are forefathers did for us. Secondly, we’ll all be in deep s**t because what criminal will register their guns. The government fears ‘we the people’ so this is their way to get us to comply and become their non-thinking robots. This bill must be killed. Write your Senators and Congressmen. I do it all the time.
Just called my pelosi-poodle “D”ope representative, and even he is not going to back this piece of trash. Plus, what LEO is going to enforce it? There are not enough GOOD LEOs in this NATION to take on the law abiding firearms owners who say NO – Like ME. Folks – call ‘em up, voice-to-voice, and make sure you keep telling them NO. And then when they don’t listen, find out who can replace them and work to make it happen – THROW THE BUMS OUT.
It’s coming. A revolution in this country. What kills me is that these “morons” in government keep getting re-elected. I hear people bitch and moan about what is going on in this country and you ask them if they even vote and half say no! What really scares me is our young generation. They expect something for nothing and are largely ingorant about the principals on which this great country was founded. They have been taught not to think for themselves. I have just read every post on this matter, I have talked to people both for and against gun control. do you people really think that they won’t pry it from your cold dead hands and if they want to from every cold dead hand that opposes them. Everybody is gripping about gun control what about all of the other rights that have been systematically stripped away. I guess those where not important enough to declare war on the UNITED STATES OF AMERICA or what you consider its government how far will you go where does it stop and how many have to die or will die. Lets face it, before we see our sons and daughter killed before our very eyes we will hand over our guns and what ever else they want. This machine is nothing new, its has been rolling silent masked from sight for decades eating away at our personal rights and pursuits. Revolt against the government, we tried this once and divided brother and brother and father and son, because what are you going to do when your own son defies you and speaks out against your beliefs and fights for the other side, because it will happen. Our children today are taught to think for themselves and that we as parents have to listen to what they have to say and not infringe on their rights. I could go on but what’s the use, there is alot that has to be protected not just gun owner rights but our way of life and traditions that our forefather fought and died for and I myself have fought for. I am a gun owner and beleave that everyone has the right to defend themselves from those who would try and take it, weather they use a gun or a baseball bat, but I will not risk the lives of my family. and those of you that would start or or even talk about a revolt think about the hole picture. We as a people are to soft we are one of the fattest countries in the world, out of shape $6.00 coffee drinking lambs and the rest want to start a fight we as a people just don’t have the stomach for.
To all of those men and women in the Armed Forces, Law Enforcement, or Fed level employment: You will be the ones that will be asked to enforce a ban on guns and ammo. You will be the ones asked to go ILLEAGLEY home to home and search for weapons. Know where you stand! When you raised your right hand and swore to protect the nation and its people you swore to “Defend against ALL ENEMIES, foreign and DOMESTIC”. Now is the time to search your soul and decide if you are going to blindly follow orders or are you going stand up and say “NO, I will not obey an ILLEAGLE order because I swore an oath not to”. The choice is yours and if you feel that you would be alone in that fight… YOU ARE WRONG! There are men and women all across the globe that are fighting to protect the rights that we established when this country was founded.
